Petition to End Funeral Poverty by Eliminating Additional Charges for State-Mandated Services
To: The Health Departments and Legislatures of the 9 States (Connecticut, Illinois, Indiana, Iowa, Louisiana, Michigan, Nebraska, New Jersey, New York), where funeral directors are required for aspects of the burial process, including witnessing a burial, filing death certificate, or transportation. Our petition seeks to eliminate these mandates and/or ensure transparent pricing for minimal services
Due to the overwhelming cost of funerals, WE, the undersigned citizens, hereby petition for the following changes:
1. Burial Witnessing by Public Health Departments or Designated OfficialsWe propose that the 9 states that mandate any policies pay for those policies. Public Health Departments or other designated officials (e.g., fire departments or sheriffs) in the above states take over the state-required role of serving as “state witness” for all citizens.
This includes:
Removal of the mandatory requirement for a private corporation to act as this witness.
Providing this witnessing service completely free to grieving families, eliminating the emotional and financial burdens during times of loss compounded by state-mandated fees.
Funding for these services should be absorbed by each state through reallocated resources or new budgetary considerations.
2. Transparent Pricing for Minimal Services We propose that until this change is implemented funeral directors in the 9 states be required to provide clear, itemized pricing for minimal services, including transportation only, witnessing only, and death certificate filing only.
Additionally, funeral directors must explicitly disclose whether families are required to hire a funeral director for these services or if families can perform these tasks themselves.
Simply we are asking for further
Clear disclosure of whether hiring a funeral director is mandatory or optional for each specific service, empowering families to make informed decisions according to their cultural, religious, or financial needs.
Rationale: Free Burial Witnessing and Transparent Pricing: Connecticut, Illinois, Indiana, Iowa, Louisiana, Michigan, Nebraska, New Jersey, and New York impose significant demands on citizens to lay a loved one to rest. The current system places an undue financial burden on grieving families, requiring them to pay funeral directors $1,000-$3,000 or more in some states for services like witnessing a burial or filing a death certificate.
Families have the right to handle their loved ones’ burial according to their cultural and religious practices, with the 9 states providing a free, unobtrusive witness to ensure legal documentation, if those states insist on a witness.
Public health departments, which already handle death certificates, or other designated officials with state training, are well-positioned to assume the witnessing role efficiently and cost-effectively.
Transparent pricing and clear disclosure of mandatory versus optional services will protect families from exploitative practices and ensure they are not forced to pay for unnecessary services.
With the growing number of funeral and cemetery service failures, families may be the best option for performing these needful life events, and they deserve clarity and freedom to make those choices.
